Terms and Conditions

The legally binding agreement between you and Workfave Limited governing your use of our services

1. About These Terms

1.1 These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Workfave Limited ("the Company"), a limited liability company registered under the Laws of the Federal Republic of Nigeria. These Terms govern your access and use of the website (www.workfave.com), platform, mobile applications, and any related services (collectively, "Services").

1.2 By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, discontinue use immediately.

1.3 You represent and warrant that you are at least 18 years old and have the authority to enter into these Terms.

1.4 You agree to provide accurate information during registration and maintain confidentiality of your account credentials.

2. Definitions

"Platform" means all the AI-enabled web and mobile-based systems operated by Workfave Limited.

"User" or "You" means any individual or entity using the Services.

"Applicant" means any user subscribing to generate or submit job applications.

"Recruiter" or "Employer" means any user accessing the platform to receive job applications.

"Subscription" means the paid plan purchased by an Applicant.

"Personal Data" has the meaning given under the NDPA 2023.

"AI Services" means automated job application generation and related tools.

3. Services

3.1 The Platform enables Applicants to search for jobs, generate Resume and Cover letters, generate and submit job applications and Recruiters to receive them. You acknowledge that the effectiveness depends on data accuracy.

3.2 The Company makes no guarantee regarding job placement, interviews, or recruiter response.

4. Acceptance and Amendment of Terms

4.1 The Company may revise these Terms from time to time. Changes will be notified via the website and take effect upon posting.

4.2 If you do not accept the amendments, discontinue use immediately.

4.3 Continued use after amendment constitutes acceptance.

5. Account Use

5.1 Each User may maintain only one personal account unless otherwise authorized.

5.2 You are responsible for maintaining confidentiality of your credentials.

5.3 Notify us immediately of unauthorized access.

5.4 We may suspend or terminate accounts for breach of Terms or fraudulent activity.

6. Subscription, Payment, and Refund Policy

6.1 Subscription fees are due upon plan selection and billed in the applicable currency.

6.2 By providing payment details, you authorize us to charge subscription fees, including for auto-renewals unless canceled before renewal.

6.3 Refunds will only be issued in the following cases:

a) Technical failure preventing access for more than 72 hours where the Service has not been used.

b) Duplicate billing due to system error (only additional charge refundable).

6.4 Refund requests must be submitted to settlement@workfave.com within seven (7) days of payment.

6.5 Refunds will be processed within fourteen (14) business days to the original payment method, less applicable processing or transaction fees.

6.6 No refunds for dissatisfaction arising from user error, incomplete data, or unrealistic expectations.

6.7 All payments are final and non-refundable unless expressly stated.

7. Prohibited Use

Users must not:

a) Interfere with platform security;

b) Provide false information;

c) Use the platform for unlawful purposes;

d) Reverse engineer or attempt to replicate services.

Violation may result in suspension, legal action, or reporting to authorities.

8. Intellectual Property

8.1 All platform content and technology are owned by the Company or its licensors.

8.2 Users may not copy, modify, distribute, or reverse-engineer any part without prior written consent.

9. Data Privacy

9.1 Personal data is processed in accordance with NDPA 2023.

9.2 Recruiters must use applicant data solely for recruitment-related purposes and delete upon request or completion.

9.3 The Company takes reasonable steps to safeguard user data but cannot guarantee full security.

10. Limitation of Liability

10.1 The Services are provided on an 'as-is' basis.

10.2 The Company shall not be liable for indirect, consequential, or special losses including loss of business, profits, or data.

10.3 Our maximum liability shall not exceed the total subscription fees paid in the 12 months preceding the incident.

11. Indemnity

You agree to indemnify and hold harmless the Company, its employees, and affiliates from any claims arising from your use of the Services, including reliance on AI-generated content.

12. Governing Law and Dispute Resolution

These Terms are governed by the Laws of the Federal Republic of Nigeria. Any dispute shall be referred to arbitration in Lagos, Nigeria, in accordance with the Arbitration and Conciliation Act before court proceedings.

Binding Agreement

By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms. These Terms constitute a legally binding agreement between you and Workfave Limited. If you do not agree to these Terms, you must discontinue use of the Services immediately.
